1. Introduction

These Terms & Conditions govern the use of the AERIEN MEDIA website and the digital marketing and related services offered by AERIEN MEDIA.

AERIEN MEDIA is a proprietorship owned by Abhinav Valiyaveetil, operating under the trade name AERIEN MEDIA.

By using our website, contacting us about our services, or engaging us for a project, you agree to these terms where applicable. If you do not agree, please do not use the website or engage our services.

AERIEN MEDIA provides digital marketing and related services. Depending on the agreed project, these may include digital strategy, social media marketing, advertising campaign management, search engine optimisation, content-related services and other digital marketing solutions.

The exact services, deliverables and responsibilities for each engagement will be described in the relevant proposal, quotation, invoice or written agreement.

3. Customised pricing and payment

Our fees are customised according to the client’s requirements, location, project scope, duration and deliverables.

Before work begins, we will communicate the applicable fees and payment terms. The client must make payments in accordance with the agreed quotation, invoice or written payment schedule.

4. Client responsibilities

Clients agree to:

  • Provide accurate information and necessary materials for the project.

  • Provide timely access to relevant accounts, platforms and resources where required.

  • Ensure that they have the rights and permissions to use materials supplied to us.

  • Review and approve content, campaigns and deliverables in a timely manner.

  • Comply with applicable laws and the terms of third-party platforms.

  • Make payments according to the agreed terms.

Delays in receiving information, approvals or access may affect project timelines.

5. Scope changes and additional work

The agreed proposal or written confirmation defines the project scope. Requests outside that scope may require additional fees, revised timelines or a separate agreement.

We will communicate material changes to the client before undertaking additional work.

6. Third-party platforms and services

Our work may involve third-party platforms, advertising networks, software providers, hosting services or other external tools.

AERIEN MEDIA does not control third-party services, their policies, availability, pricing, algorithms or decisions. We cannot guarantee that a third-party platform will approve an advertisement, maintain an account, preserve a particular feature or deliver a particular result.

Clients remain responsible for complying with the terms and policies of platforms they use.

7. Results and performance

Digital marketing outcomes depend on several factors, including market conditions, competition, advertising budgets, platform algorithms, client-provided materials and audience behaviour.

We do not guarantee specific sales, leads, rankings, revenue, audience growth or advertising performance unless a specific written commitment expressly states otherwise.

We will provide the services and deliverables agreed for the engagement with reasonable professional care.

8. Intellectual property

Unless otherwise agreed in writing, each party retains ownership of intellectual property it owned before the project.

The ownership, permitted use and transfer of project-specific materials, creative work, content, campaign assets and other deliverables will be governed by the applicable proposal or written agreement.

Clients must not use third-party materials without the necessary permissions or licences.

9. Confidentiality

Both parties should treat non-public business, commercial and project information received from the other party as confidential and use it only for the relevant engagement, except where disclosure is required by law or authorised by the relevant party.

10. Cancellation and refunds

Cancellation requests and refund eligibility are handled in accordance with our Refund & Cancellation Policy and the specific terms agreed for the project.

Any applicable third-party costs, work already completed and payments due under the agreed scope may be considered when assessing a cancellation or refund request.

11. Website use

You agree not to misuse our website, attempt unauthorised access, interfere with its operation, or use it for unlawful purposes.

Website content is provided for general information and may be updated from time to time.

12. Limitation of liability

To the extent permitted by applicable law, AERIEN MEDIA will not be responsible for indirect or consequential losses arising from the use of our website or services, including losses caused by third-party platform changes or interruptions.

Nothing in these terms excludes liability that cannot lawfully be excluded or limited.

13. Changes to these terms

We may update these Terms & Conditions from time to time. The updated version will be published on this website with a revised update date.

14. Governing law

These terms are governed by the laws of India. Subject to applicable law, disputes will be subject to the jurisdiction of the competent courts in Hyderabad, Telangana, India.
